1. The service

We provide free online games that you can play in your web browser. We may add, change or remove games and features at any time, and the site may occasionally be unavailable for maintenance or reasons outside our control.

2. Who can use the site

The site is intended for a general audience. If you are under the age of majority where you live, please use the site with the permission and supervision of a parent or guardian.

3. Acceptable use

• copy, re-publish or sell the site or its games, except where a game's own open-source license allows it;
• interfere with the site, its security or its advertising (for example with bots, scraping, hacking or automated clicks on ads);
• use the site for anything unlawful, harmful or abusive.

4. Games and intellectual property

The website design, text and logo belong to PlayToucan. Each game belongs to its developer or publisher. Open-source games are provided under their own licenses (for example MIT, BSD, Unlicense or GPL); the license and a link to the source code are shown on each game's page and on our About page, and those licenses apply to the game's code. Games from distribution partners are provided under agreements with those partners. All trademarks, game names and characters belong to their respective owners.

5. Advertising

The site is free and supported by advertising, including ads shown by partners inside or around games. We are not responsible for the content of third-party ads or for products and services they offer. Please see our Privacy Policy for how advertising cookies work and how to opt out of personalized ads.

6. Third-party content and links

Some games, scripts, fonts and links come from third parties. We do not control and are not responsible for third-party websites, content or services, and your use of them is subject to their own terms.

7. Game progress

Favorites, likes, high scores and game progress are stored only in your browser. They can be lost if you clear your browser data or change device, and we cannot restore them.

8. Copyright complaints

We respect intellectual property. If you believe content on the site infringes your copyright, email contact@playtoucan.com with: the page URL, a description of your work, your contact details, and a statement that you are the rights holder or authorised to act for them. We will review the notice and remove content where appropriate.

9. Disclaimer

The site and all games are provided "as is" and "as available", without warranties of any kind. We do not guarantee that the site or any game will be error-free, uninterrupted, or work on every device or browser.

10. Limitation of liability

To the maximum extent permitted by law, PlayToucan is not liable for any indirect, incidental or consequential damages, or for any loss of data, arising from your use of, or inability to use, the site or its games.

11. Changes to these terms

We may update these Terms of Use from time to time. The "Last updated" date shows the latest version. Continuing to use the site after a change means you accept the updated terms.
